Division of Building and Uniform Construction Code

The Construction Code Office administers and enforces the New Jersey State Uniform Construction Code (UCC) by:
  •  Processing permit applications for new and existing building construction
  • Reviewing applications for compliance with the UCC
  • Conducting inspections and issuing certificates of occupancy or approval

Effective March 5, 2018 the NJ Department of Community Affairs (NJDCA) has adopted changes to Minor Work and Ordinary Maintenance that may impact your construction project. “SIGNIFICANT CHANGES TO MINOR WORK AND ORDINARY MAINTENANCE” are outlined within the following NJDCA web link: http://www.nj.gov/dca/divisions/codes/alerts/pdfs/OM_MW_03052018.pdf
Permit Application Process

Construction Code Permits are a certification to all interested parties that an applicant intends to do construction work of a type which is regulated by the UCC. If an applicant is unsure about whether a Construction Code Permit is required, the office staff is available to help with the determination. Generally speaking, a permit is needed for any new construction work, additions to structures, renovations or alterations affecting changes of use or egress. Permits are also needed for maintenance items such as siding, roofing, window replacement where opening size is changed, furnace, water heater and replacement of decks and balconies.

While the Town has up to 20 business days to review the permit application most reviews are completed sooner. Unless the work falls under “ordinary maintenance” per the UCC, permits are legally required.

A Construction Code Permit application needs to be submitted for each of the Subcode technical sections which pertain to the work along with two copies of construction plans for the work. The Subcode technical sections include Building, Electrical, Plumbing, Fire, and Elevator.

Construction work often requires approvals from other agencies before a Construction Code Permit may be issued. These prior approvals may include Zoning or Health approvals.

**Construction Code Permit application forms may be acquired HERE.

Plans are required for most projects and must be prepared, signed and sealed by a licensed New Jersey Architect. However, for single family residences the resident homeowner may prepare plans for their own use.

Inspections

Inspections may be scheduled by calling the Construction Code offices at least 24 hours before the inspection is desired. The scheduling of inspections is workload-dependent, and inspections are performed as soon as possible. Inspections must be scheduled for each Subcode for which a permit was issued.

Certificates
There are several types of certificates which are regulated by the UCC and issued by the Construction Code office;

  • New buildings, additions, and altered spaces require a Certificate of Occupancy
  • The Construction Official may issue a Temporary Certificate of Occupancy in limited circumstances when occupancy is imperative and only minor outstanding items of work remain to be accomplished
  • All other work receives a Certificate of Approval
