Rent Increase
Notification of Rent Increase
The landlord must notify the Division of Rent Leveling and the tenant at least sixty (60) days before an increase. He may do this by personal service or the U.S. Mail, on forms supplied by the Division.
Allowable Percentage Increase (API)
Either the Consumer Price Index (CPI) or that portion of the Housing component listed as “Residential Rents for All Urban Consumers of New York – Northeastern New Jersey,” whichever is less.
Sewer Surcharge
Expenses incurred for 50% of the sewer bills may be passed through to tenants on a square-footage basis. No more than four (4) quarters of sewer bills may be charged to a tenant in any twelve month period.
The Division of Rent Leveling and tenant must be appropriately notified prior to the surcharge becoming effective.
Reserved Rent
A landlord can choose to reduce the rent or choose not to pass on the API increase by placing it in a “Reserve” account (Line 10 on form). The landlord must notify the Division of Rent Leveling and tenant in writing via the yearly registration form supplied by this office.
